Chris Brown after his suspended sentence: a thumbs-up, a lawyer's apology and a tour restart with Usher
Chris Brown walked out of Southwark Crown Court in London on Monday to loud cheers, stopped to sign what appeared to be an autograph and, a short time later, posted a thumbs-up from his car. A day after his eight-month suspended sentence for a 2023 nightclub attack, the focus has shifted to what the ruling means and what comes next for the singer.
How Chris Brown reacted
Brown did not issue a formal public statement after the hearing. According to the BBC, he shared a video on his Instagram story from inside a car, looking out the window before turning to the camera and giving a thumbs-up.
Inside court, the reaction was quieter. Brown and his co-defendant, vocal coach Omololu Akinlolu, stood, faced each other and clasped hands after the judge finished his remarks, the BBC reported.
The only apology on the record came through his lawyer. Sallie Bennett-Jenkins KC told the court:
“This is an ugly and unattractive incident. It is, however, an incident which was very short-lived, lasting something more than 17 seconds but no more than 20.”
She said Brown “offers a profound apology to all those present” and described him as “a dedicated and a loving father of four children.”
Why the judge didn’t send him to prison
Judge Tony Baumgartner said both men had crossed the threshold for a custodial sentence. But under changes to sentencing law in England and Wales this year, sentences of 12 months or less are suspended unless a judge finds exceptional circumstances, the BBC and CBC explained.
“I have considered whether the seriousness of the offending, taken together with the need for punishment and deterrence, amounts to exceptional circumstances requiring immediate imprisonment,” the judge said, per the BBC. “I have concluded, in relation to each of you, that it does not.”
Factors the court weighed, according to the BBC and CBC:
| Weighed against Brown | Weighed in his favor |
|---|---|
| He started the violence | Guilty plea |
| Repeated bottle strikes to the head | No planning; about 20 seconds long |
| Continued aggression as the victim moved away | Complied with bail conditions |
| A crowded nightclub, risking others | Impact on his young children |
The judge also said Brown’s “risk of further offending is low” and added that his fame, commercial success and professional standing “do not entitle you to special treatment.”
New details from the hearing
- The victim’s injuries: Music producer Abraham Diaw was treated at St Mary’s Hospital and later had an MRI showing a “high grade injury” to a knee ligament, the court heard. The defense disputed how serious the injuries were.
- The victim stepped back: Diaw was “not supportive of the prosecution” and withdrew his support at some point, the BBC reported. Rolling Stone noted Diaw dropped a $16 million lawsuit against Brown in June 2025.
- Charges dropped: Brown had denied more serious charges of assault, attempting to cause grievous bodily harm and possessing an offensive weapon, which were dropped after his affray plea in July.
What happens next
The 12-month suspension is now in effect. Brown won’t serve the eight months unless he commits another offense during that period, CBC reported.
His career is moving ahead. Brown had canceled three dates of his joint R&B Tour with Usher around the time of the sentencing, and Rolling Stone reported the tour resumes Nov. 5 at Mercedes-Benz Stadium in Atlanta.
The case also adds to a long legal history. CBC noted his 2009 guilty plea for assaulting Rihanna, which led to five years’ probation, and a 2014 jail stint linked to a separate assault case in Washington, D.C.
