AT&T settlement: Will the $177 million data breach payout arrive in December? What claimants can expect
Many people who filed claims in AT&T’s $177 million data breach settlement are hoping for money before the holidays. Based on the settlement’s own timeline, a December payout is possible but far from guaranteed. One date matters more than any other right now: Monday, Nov. 2, the deadline to appeal the court’s approval.

Where the case stands now
Senior U.S. District Judge Sidney A. Fitzwater of the Northern District of Texas approved the settlement on Oct. 2, 2026. The case covers two 2024 incidents: a breach disclosed in March and a second one in July involving call and text records. As of this week, no payment date has been announced, and the official settlement website says payments go out only after any possible appeals are resolved.
The approval also showed how many people are waiting. According to The Money Overview, citing a report on the court order:
| Claims | Number |
|---|---|
| Received | 4,918,073 |
| Allowed (all tiers) | About 3.92 million |
| Rejected | 1,099,732 |
| Flagged as fraudulent (among rejected) | 804,381 |
The outlet noted that the published totals don’t balance exactly and that the administrator, Kroll, is still working through deficient and fraud-flagged claims, so final tier counts could shift slightly.
Could AT&T settlement payments come in December?
Here is the no-appeal timeline, based on the settlement agreement as described by The Money Overview. These are calculations, not announcements:
- Nov. 2, 2026: The 30-day appeal window closes (the 30th day falls on a Sunday, so it rolls to Monday).
- About Nov. 12: The projected “Effective Date,” 10 days after the appeal window ends.
- About Nov. 27: AT&T’s deadline to fund the rest of the settlement, 15 days after the Effective Date.
- About Jan. 11, 2027: The latest the administrator can distribute payments, 60 days after the Effective Date.
The agreement sets a deadline, not a start date. Payments must go out no later than 60 days after the Effective Date, so money could in theory arrive in December. Still, no source has reported a December target, and The Money Overview described the second week of January 2027 as the earliest realistic payout date if the window closes quietly. Anyone counting on a December check should treat it as a possibility, not a plan.
What would push payments back
An appeal would reset the clock. About 45 objectors opposed the deal, and the judge rejected most of their arguments, The Money Overview reported. If one of them appeals, the Effective Date moves to 30 days after the appeal is resolved, which could take months.
The same report noted that a separate final judgment, if the court enters one, could restart the appeal clock and delay payments by roughly five months.
How much claimants could receive
USA Today, citing settlement documents, listed these estimated tier payments:
| Tier | Who it covers | Estimated payment |
|---|---|---|
| AT&T 1, Tier 1 | Social Security numbers exposed in the first breach | $39 to $40 |
| AT&T 2, Tier 2 | Second breach | $7.50 to $8.10 |
| AT&T 2, Tier 3 | Second breach | $6.50 to $7.10 |
Claimants who documented actual losses are paid first, up to $5,000 for the first breach and $2,500 for the second, before tier amounts are calculated. Class counsel’s fees are about $59 million, roughly one-third of each fund, and administration costs have grown well beyond the original estimate, which is part of why the per-person tier amounts are small.
Is there a separate Texas payout date?
No separate schedule has been reported. The case is in federal court in Dallas, which is why Texas outlets follow it closely, but the same timeline applies to every class member with a valid claim.
What to watch for
Since the claim deadline (Dec. 18, 2025) has passed, people who already filed only need to watch for three things:
- Any notice of appeal or separate final judgment in the court docket
- A posted Effective Date on the settlement website
- A payment notice from Kroll, by paper check or electronic payment
